What is Alojamento Local?
Alojamento Local, usually shortened to AL, is the legal category for any property let to tourists for consideration, for periods under 30 days, that is not classified as a tourist development. The regime is set out in Decreto-Lei n.º 128/2014 of 29 August, amended by Lei n.º 62/2018, Lei n.º 56/2023 and, most recently, Decreto-Lei n.º 76/2024 of 23 October.
The law provides four modalities: moradia (house), apartamento (apartment), estabelecimento de hospedagem (guest house) and quartos (rooms). The modality you choose determines different requirements, particularly around condominium consent and maximum capacity.
In practice there is no licence in the traditional sense. What the law requires is a comunicação prévia com prazo, a prior notification with a waiting period, submitted through the Balcão Único Eletrónico. This generates a Registo Nacional de Alojamento Local number, the RNAL. Without that number the activity is illegal and cannot be advertised on any platform.
Why Alojamento Local Matters
The sector now accounts for a meaningful share of Portugal's tourist accommodation supply and a significant proportion of overnight stays outside traditional hotels. For an individual owner, it is one of very few ways to convert an underused property into a recurring income asset with delegable management.

The relevant comparison is not between short-term rental and a term deposit. It is between short-term rental and a long-term tenancy on the same property.
Traditional letting offers predictability, low operating costs and continuous occupancy. Alojamento Local offers substantially higher gross revenue per night, but with seasonality, higher operating costs and an occupancy rate that rarely reaches 100 percent.
In areas of established tourist demand — the major cities, the Algarve, Madeira and the Azores — the income differential still favours short-term rental in most cases. In areas with a narrow seasonal window, the calculation flips easily.
Costs and Actual Profit
An honest model has to include platform commissions, typically between 3 and 17 percent depending on the model you sign up to; cleaning and laundry between stays; utilities, which in Alojamento Local are borne by the owner; the mandatory civil liability insurance required under Portaria n.º 248/2021; accelerated maintenance driven by high guest turnover; the municipal tourist tax where the council applies one; and accounting plus compliance software.
On the tax side, the simplified IRS regime applies a coefficient of 0.35 to Alojamento Local income in the house and apartment modalities, rising to 0.50 where the establishment sits in a containment area. Above the exemption threshold in Article 53 of the CIVA — 14,500 euros of turnover in 2026 — VAT also applies, at the reduced 6 percent rate on the accommodation service.

One important point: Decreto-Lei n.º 76/2024 revoked the rule under which inactive registrations lapsed automatically. A registration with no activity no longer expires on that basis, which restores real flexibility for anyone operating intermittently.

The Registration Process
The procedure is entirely electronic.
Authenticate on the Balcão Único Eletrónico using your Cartão de Cidadão, Chave Móvel Digital or a digital certificate. Submit the comunicação prévia com prazo, stating the address, modality, capacity and the party operating the establishment. The RNAL number is issued automatically on submission.
The mayor then has 60 days to oppose the registration, extended to 90 days in containment areas. Inspection deadlines for verifying compliance run in parallel. If the period expires without opposition, the registration stands.
The RNAL number must appear in every listing and on every platform. The comprovativo do exercício da atividade, the proof of activity obtained through the Balcão Único, is the document that evidences a valid registration to platforms, insurers and inspectors.
Licensing and Regulation
Decreto-Lei n.º 76/2024, in force since 1 November 2024, substantially changed the picture compared with 2023. It revoked the national suspension of new registrations for apartments and guest houses in autonomous fractions; the five-year renewable validity period for registrations; the mandatory 2030 review of existing registrations; the automatic lapsing of inactive registrations; the non-transferability of registrations, which now follow the property on a sale; the requirement for condominium consent, which survives only for hostels in autonomous fractions; and the CEAL, the extraordinary levy on short-term rentals, which had already been repealed in August 2024.
In exchange, power over containment areas returned entirely to municipalities. Councils with high registration numbers can limit or prohibit new establishments in specified parishes, condition the transferability of registrations in the house and apartment modalities, and apply their own regulations.
Councils can also now cancel a registration, following a prior hearing of the interested party, in three situations: absence of valid mandatory insurance, or failure to supply proof within three days of a council request; repeated and proven conduct disturbing the normal use of the building; and, in containment areas, the signing of a permanent residential tenancy in the two years preceding the prior notification, in breach of the applicable municipal regulation.
The practical conclusion: before you buy, check the municipal regulation and the containment area map for that council. It is the single variable that most often kills an otherwise sound investment.

Working With Local Businesses
Hosts who build relationships with nearby restaurants, activity operators and transfer services consistently see better reviews and a higher share of direct bookings. The relationship runs both ways and it is measurable.
Municipal Incentives
Some councils offer urban rehabilitation support, IMI property tax relief for buildings restored within designated rehabilitation areas, and reduced licensing fees. These schemes vary by council and by parish, so confirm them with the municipality before committing to a purchase.
